About these Terms

These Terms of Service ("Terms") govern your use of the Horizon EMDR website and platform (the "Service"). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.

Who we provide the Service to

The Service is intended for qualified EMDR practitioners and therapy organisations. You are responsible for ensuring you are appropriately qualified and licensed to provide therapy services in your jurisdiction and that your use of the Service complies with all applicable laws and professional guidance.

What the Service provides

Horizon EMDR provides tools to support therapy sessions, including visual bilateral stimulation (BLS) controls and related features. The Service is not a medical device and does not provide clinical advice. You remain solely responsible for clinical decision‑making, safeguarding, and outcomes for your clients.

Privacy and data protection

We take a privacy‑first approach. We do not offer session recording or client progress tracking. Personal data is handled in accordance with our Privacy Policy. You are responsible for obtaining any necessary consents from clients and for your own compliance obligations under data protection law.

Accounts, security, and acceptable use

  • Keep your account credentials secure and do not share them.
  • Do not use the Service for unlawful, harmful, or abusive purposes, or to infringe the rights of others.
  • Do not attempt to probe, scan, or test the vulnerability of the Service, or to disrupt or overload it.
  • Only upload or enter information you are lawfully permitted to handle and share.

Subscriptions, billing, and trial

Paid subscriptions are billed by our payment partner Lemon Squeezy, who acts as seller/merchant of record and handles VAT where applicable. Plan prices, billing cadence (monthly or annual), and any free trial length are shown at checkout. Trials convert to paid at the end of the trial unless cancelled beforehand.

You can cancel future renewals at any time via the subscription management link provided at purchase. Access continues until the end of the current paid period. Refunds are not guaranteed and are assessed case‑by‑case where required by law.

Taxes and invoices

Prices may exclude VAT or other taxes, which are determined at checkout based on your location and status. Invoices and receipts are issued by Lemon Squeezy as merchant of record.

Service availability and changes

We aim to provide a reliable Service but do not guarantee uninterrupted or error‑free operation. We may modify, suspend, or discontinue features to improve performance or security, or to comply with law. Where a material change negatively affects your use, we will provide reasonable notice when practicable.

Third‑party services

The Service may integrate with or link to third‑party services (e.g., payment processing, form handling). Those services are provided under their own terms and privacy notices; we are not responsible for third‑party content or practices.

Intellectual property

We retain all rights in the Service, software, and content. You are granted a limited, non‑exclusive, non‑transferable licence to use the Service in accordance with these Terms. You may not reverse engineer, copy, or create derivative works except to the extent permitted by law.

Clinical and safety responsibilities

You are responsible for ensuring the Service is appropriate for your client and for adapting BLS parameters to your clinical judgement. Always use your professional training and follow safeguarding procedures. Do not rely on the Service as a substitute for clinical supervision or emergency protocols.

Limitation of liability

Nothing in these Terms limits liability that cannot be limited under law (including liability for death or personal injury caused by negligence, or for fraud). Subject to the foregoing, we are not liable for loss of profits, loss of data not caused by us, consequential or indirect losses, or any losses arising from factors beyond our reasonable control. To the extent permitted by law, our aggregate liability arising out of or relating to the Service is limited to the fees paid by you for the twelve (12) months preceding the event giving rise to liability.

Consumer rights

If you are a UK consumer, you may have statutory rights that cannot be excluded. Nothing in these Terms affects those rights. For digital services, your cancellation rights may be affected once service delivery begins with your consent.

Termination

You may stop using the Service at any time. We may suspend or terminate access if you materially breach these Terms, to protect the Service, or where required by law. Upon termination, your right to use the Service ends immediately.

Governing law and jurisdiction

These Terms and any non‑contractual obligations are governed by the laws of England and Wales. The courts of England and Wales will have exclusive jurisdiction, except that you may also have rights to bring a claim in your local courts as a consumer where applicable law requires.

Changes to these Terms

We may update these Terms to reflect changes in our Service or the law. We will post the updated Terms with a revised effective date. If a change is material, we will provide reasonable notice.
